Our services are provided on a subscription basis with different feature tiers. We reserve the right to modify, suspend, or discontinue any aspect of our service at any time with reasonable notice.
To use MonteMedia.ai, you must create an account and connect your TikTok account. You agree to:
Provide accurate, current, and complete account information during registration and keep it updated
Maintain the security and confidentiality of your account credentials
Be solely responsible for all activities that occur under your account
Notify us immediately of any unauthorized access or security breach
Ensure your TikTok account complies with TikTok's Terms of Service
Not share your account credentials or allow others to access your account
Not create multiple accounts to circumvent restrictions or abuse our service

Infringe upon intellectual property rights, including copyrights, trademarks, or patents of others
Violate privacy rights or publish personal information of others without consent
Use our service for spam, unsolicited marketing, or bulk automated posting
Attempt to circumvent, disable, or interfere with security features of our platform
Reverse engineer, decompile, or attempt to extract source code from our service
Use automated bots, scripts, or scraping tools without authorization
Overload, disrupt, or impair our servers or networks
Violate TikTok's Community Guidelines or Terms of Service when posting content
Resell, redistribute, or sublicense our service without written permission
Violation of this Acceptable Use Policy may result in immediate account suspension or termination, and we may report illegal activities to law enforcement authorities.
You retain all ownership rights to the videos and content you create using MonteMedia.ai. However, to provide our services, you grant us a limited, worldwide, non-exclusive, royalty-free license to:
Host, store, and process your content on our servers
Display your content to you within our platform interface
Publish your content to TikTok on your behalf as authorized by you
Use anonymized, aggregated content data to improve our service quality
This license terminates when you delete your content or close your account, except for content that has already been shared or where we have a legal obligation to retain it.
MonteMedia.ai and all its components—including software, algorithms, designs, logos, trademarks, and documentation—are owned by us and protected by intellectual property laws. You may not:
Copy, modify, or create derivative works of our platform
Use our trademarks, logos, or branding without written permission
Claim ownership of or remove proprietary notices from our materials
Content generated by our service is provided to you for your use. You are responsible for ensuring that generated content complies with applicable laws and third-party rights before publishing. We make no warranties regarding the originality or copyright status of generated content.
MonteMedia.ai is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not guarantee that:
The service will be uninterrupted, timely, secure, or error-free
Videos will be published successfully to TikTok every time
Generated content will meet your expectations or be free from errors
The service will be compatible with all devices or browsers
We integrate with TikTok's API, but we are not affiliated with, endorsed by, or officially connected to TikTok. We are not responsible for:
Changes to TikTok's API, policies, or terms that affect our service
TikTok account suspensions, bans, or restrictions resulting from content you publish
TikTok's handling, storage, or deletion of videos published through our platform
TikTok service outages or technical issues preventing video uploads
Content moderation decisions made by TikTok regarding your videos
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MonteMedia.ai, its officers, directors, employees, and affiliates SHALL NOT BE LIABLE FOR:
Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Damage to your TikTok account or reputation
Errors, bugs, or inaccuracies in generated content
Unauthorized access to or alteration of your content or data
Our total liability for any claims related to our service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
We reserve the right to suspend or terminate your account at any time, with or without notice, for:
Violation of these Terms of Service or our Acceptable Use Policy
Fraudulent activity or payment disputes
Suspicious or harmful behavior that threatens our service or other users
Extended periods of inactivity (typically 12+ months)
Legal requirements or court orders
Upon termination:
Your access to the service will be immediately revoked
Your TikTok account connection will be disconnected
Your content may be deleted in accordance with our data retention policy
You will not be entitled to refunds for any prepaid subscription fees (except where required by law)
You may terminate your account at any time through your account settings. Upon voluntary termination, you will have 30 days to download your content before permanent deletion.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or your use of MonteMedia.ai shall be resolved through:

Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.

The foregoing arbitration provisions do not apply to disputes that may be brought in small claims court or disputes related to intellectual property rights.
